Terms & Conditions.
1 Payments/booking fee
The client has 14 days to cancel the services of photographer. After 14 days if the photographer hasn't been notified of cancellation by email address provided the deposit is non - refundable.
A non-refundable £250 deposit or other agreed amount will be deemed as full acceptance of the terms and conditions of this contract. This deposit secures the time and services of the Photographer (s) for the wedding and is non refundable or transferable in the event of cancellation. In the unlikely event of the total cancellation of services by the client closer to the actual Wedding date - part or total outstanding balance is to be paid to KK Snaps Photography. (please see cancellation section)
Once the deposit is received and the necessary details agreed the booking is finalised.
2 KK Studio & Events do not accept any further payment until 4 weeks before date of Wedding. If client pays any other amounts prior to the 4 week payment date, this is also non refundable if cancellation occurs.
If the Wedding is moved to an alternative date the deposit can be transferred to this date as long as a photographer can reschedule for the new date and time and this isn’t in an unrealistic time scale for example less than 12 weeks to the Wedding date.
3. Cancellations
The contract can be cancelled at any time by the client but in doing so, deposit or further payment made will be at a part or total loss. Cancellation of contract 6 weeks or less to Wedding date will result in client paying full amount of the agreed total outstanding balance. If cancellation occurs between 6 and 12 weeks before the Wedding date half of agreed outstanding balance must be paid. All cancellations must be in writing to the photographer from one of the emails provided in contact details.
4. Wedding Preparations
A plan of the Wedding day and details of wedding must be agreed before the wedding date at the final consultation, between the client and photographer, failing this details must be provided to the photographers during a telephone consultation. Photographers shall be notified by client of any changes to time or date of wedding prior to wedding date. Photographer cannot be held responsible for delay or failure to attend Wedding date if changes aren't sent to photographer and acknowledged by the photographer prior to wedding.
5 Images display and ownership
The client gives permission to photographer to use, display, use images taken to advertise and promote the business in anyway they see fitting. For example social media, sample albums, websites, online articles or magazines.
The photographs will be displayed at 300ppi and to a colour that is aesthetically pleasing to the photographer and this will be seen to be correct. The Photographer recommends using a modern laptop, computer or tablet to view images. Television screens can stretch or distort images and photographer cannot be held responsible for this. Photographer cannot guarantee exact colour of digital images due to different screen and monitors calibrations and different software systems.
6 Ceremony or Service
For a church ceremony or certain services the person conducting service/ ceremony may have some conditions about where the photographer can stand or move freely. The areas in which the photographer can cover may be restricted by the official, guests or other person and the area covered may not be the choice of the photographer. The photographer cant be held responsible for any obstructions or limits of view if this is the case.
7. Retouching
By the judgement of the photographer/editing team the images will be edited and airbrushed in a way they feel suitable. The sharpness, colours, brightness and contrast will be adjusted as seen to be correct by the photographer. It is understood that the client is seen to be hiring the photographer for their technical and artistic expertise, therefor its seen the photographer/editing team can edit the photographs in anyway they feel fit, taking into account the clients requests. General airbrushing Slimming and advanced airbrushing is available to the client at their request, no addition payment is required for general editing and airbrushing . Out with the bridal party, other persons can be slimmed and airbrushed at an attentional cost. This will be agreed by both parties at the time of the final consultation/telephone consultation.
8 Posing and requested images
The photographer will be given artist licence and deemed correct when choosing the poses and location at the venue. The client shall assist and cooperate with the photographer in obtaining the desired photographs, including but not limited to specifying persons or scenes to be photographed. The photographers judgement of locations around the venue, poses used and lighting techniques will be deemed correct. Due to the willingness of persons, time running over and weather conditions some of the images requested by client may not be possible. The photographer shall not be responsible for photographs not taken as a result of clients failure to provide reasonable assistant or cooperation.
9 Copyright
Joint copyright is given to both KK Studios ( the owners of the company) and the client. The client can print, display, use and recopy the Wedding photographs provided by the photographer. It is the responsibility of the client to store the digital images/prints in a safe place. It is recommended the client backs up (copies) the images to another device other than USB or online gallery provided. Where an online gallery is provided the client has one year use of this gallery. The client can download and purchase prints from their online gallery and have the option to extend after that one year expires. Digital images will be kept by the photographer for 12 months after wedding date. This allows the client to receive another copy of their wedding images if lost, this is by the photographers discretion and if they still have them on back up hard drive/storage. If digital images are lost by client after receiving them the photographer has no required responsibility to provide client with another copy but they will do so where possible at an additional cost.
10 Equipment
Although Regular checks of equipment are taken the photographer cannot guarantee that failure will not occur. Due to unforeseen circumstances, accidental damage by photographer or other, photographer will not be held responsible for failure to produce images due to the unlikely event of technical failure of equipment. In the unlikely event that all or some photographs are lost, stolen, damaged or destroyed due to reasons out with or beyond the photographs control then liability is limited to the return of total payments received for the value of contract agreed.
11. Limitation of liability
In the unlikely event of photographers sickness/ failure to attend Wedding a replacement photographer will be provided where possible.
In the unlikely event of a total photographic failure, loss of images, failure to attend or cancellation of this contract by either party or in any other circumstance, the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
12.
Complaints
If there are any issues with the USB, the digital images or the Wedding Book provided by the photographer, the client shall notify the photographer within 7 days of receiving photographs, digital or other. After the 7 days it is understood that the client is satisfied with photographs.
13. Personal accidents
Any directions issued to clients, their guests or employees during a photographic shoot are deemed to be at said persons own risk. The photographer cannot be held responsible for any personal accidents during a photographic shoot.
The terms of this contract are accepted by any client agreeing to have their Wedding day photographed by a member of the KK Studio & Events team.
